Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Calm Stoic mobile application ("the App"), developed and operated by Neurakara Labs ("Neurakara Labs", "we", "us", or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Important Disclaimers

1.1 AI-Generated Content Disclaimer

All responses from AI personas are generated by artificial intelligence and may be:

• Inaccurate: AI may produce incorrect, misleading, or nonsensical information
• Inappropriate: AI responses may not be suitable for your specific situation
• Inconsistent: Different conversations may yield different or contradictory advice
• Not personalized medical advice: Despite the memory system that personalizes responses, the AI does not have medical training and cannot assess your clinical needs

You should exercise your own independent judgment when considering any guidance from AI personas. We strongly encourage you to seek professional help for mental health concerns.

1.2 Reporting AI Content

If an AI persona generates content that you find offensive, harmful, inaccurate, or inappropriate, you may report it through the in-app reporting feature or by contacting support@calmstoic.com. We review user reports to improve our content moderation systems.

You must be at least 18 years of age to use Calm Stoic.

By creating an account, you confirm and represent that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• Your use of the App complies with all applicable local, national, and international laws

This age restriction is implemented in compliance with Government Regulation No. 17 of 2025 on Child Online Protection ("GR 17/2025") and reflects the sensitive nature of mental wellness content. By continuing to use Calm Stoic, you confirm that you are at least 18 years of age. We do not knowingly collect data from individuals under 18.

If we discover that a user under 18 has created an account, we will promptly suspend the account and delete all associated personal data in accordance with our Privacy Policy.

3. Account Registration & Security

3.1 Account Creation

To access certain features, you must create an account by providing a valid email address and creating a password. You may optionally set up biometric authentication (fingerprint/face) or a PIN for convenient access.

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately at support@calmstoic.com if you suspect unauthorized access
• Providing accurate and truthful information during registration

3.3 One Account Per Person

Each account is intended for a single individual. You may not share your account credentials or allow others to access your account. Given the personal nature of AI memory and conversation data, shared accounts may result in inaccurate AI personalization.

4. Description of Service

4.1 What Calm Stoic Provides

Calm Stoic is an AI-powered philosophical wellness application that offers:

• AI Philosopher Conversations: One-on-one chat with four AI personas
• The Stoa: Group discussions where all four AI philosophers debate your question
• Smart Journal: Free-form, guided, and AI-assisted journaling
• Mood Tracking: Emotion check-ins with pattern visualization
• Stoic Learning: Structured lessons and curated quotes
• Wellness Exercises: Breathing techniques and grounding exercises
• Ambient Sounds: Soundscapes for relaxation and focus
• AI Memory: A personalization system that remembers your context
• Gamification: Daily quests, streaks, and Stoic Seeds
• Ask AI: Direct questions to AI for philosophical guidance
• Image Analysis: Upload images for AI interpretation (Stoa tier only)

4.2 What Calm Stoic Does NOT Provide

• Medical diagnosis, treatment, or advice
• Psychological therapy, counseling, or clinical assessment
• Crisis intervention or emergency services
• Professional mental health evaluation
• Medication recommendations
• Human-to-human conversation or peer support

5. Subscription Tiers & Payments

Exact daily usage limits are displayed within the App and may be adjusted.

5.2 Billing & Auto-Renewal

Paid subscriptions are processed through Apple App Store and Google Play.

• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Billing: Your app store account will be charged at confirmation of purchase and upon each renewal
• Price changes: We may change subscription prices with reasonable notice
• Free trial: If offered, converts to paid subscription automatically unless cancelled before the trial ends

5.3 Cancellation

You may cancel your subscription at any time through the App Store, Google Play Store, or within the App settings. Upon cancellation, you retain access until the end of the current billing period.

5.4 Refunds

Refund requests are handled in accordance with the respective app store's refund policy. Contact support@calmstoic.com for assistance.

6. Stoic Seeds (Virtual Currency)

6.1 Nature of Stoic Seeds

Stoic Seeds ("Seeds") are a virtual currency used within the App for gamification purposes.

6.2 Important Limitations

• Seeds have no real-world monetary value
• Seeds cannot be exchanged for real currency or cryptocurrency
• Seeds cannot be transferred between accounts
• Seeds cannot be refunded, except as required by law

7. Acceptable Use

7.1 Permitted Use

You may use Calm Stoic for personal, non-commercial philosophical reflection, self-improvement, and wellness purposes.

7.2 Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to manipulate, exploit, or abuse the AI systems (including prompt injection, jailbreaking)
• Use the App to generate harmful, threatening, or hateful content
• Reverse engineer, decompile, or disassemble the App
• Circumvent security features, rate limiting, or access controls
• Create multiple accounts to circumvent usage limits or bans

7.3 Enforcement

Violation may result in warnings, suspension, termination, or reporting to authorities where required by law.

8. Intellectual Property

8.1 Our Intellectual Property

The Calm Stoic brand, AI persona names and personalities, app design, lesson content, software code, and audio content are owned by Neurakara Labs.

8.2 Your Content

You retain ownership of content you create (chat messages, journal entries, images, feedback). You grant us a limited, non-exclusive, revocable license to process your content solely for providing the App's services.

8.3 AI-Generated Content

AI-generated responses are provided "as is." You may use them for personal purposes but may not commercially redistribute them.

9. AI Memory System

The App's AI memory system automatically extracts information from your interactions. AI memories are automated extractions and may be inaccurate. You can disable the AI memory feature or request deletion of memories in App settings.

10. Privacy & Data Protection

Your use of the App is governed by our Privacy Policy, which describes what data we collect, how it's processed, and your rights under UU PDP and GDPR.

10.1 US State Privacy Rights

Residents of California, Virginia, Colorado, Connecticut, and other US states with comprehensive privacy laws may have additional rights regarding the collection, use, and sharing of their personal data, including the right to access, delete, correct, and opt out of certain processing activities. 10.2 International Users

Calm Stoic is available globally. For users in the European Union, India, and Brazil, additional data protection rights apply as described in our Privacy Policy, including rights under the GDPR, EU AI Act, India's DPDP Act, and Brazil's LGPD.

11. Service Availability & Modifications

We do not guarantee uninterrupted access. We reserve the right to modify features with at least 30 days' notice for material changes affecting paid subscribers. AI models used may change over time.

12. Limitation of Liability

12.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

12.2 Limitation of Liability

Neurakara Labs shall not be liable for indirect, incidental, or consequential damages. Total aggregate liability shall not exceed the amount paid in the twelve months preceding the event. For Free tier users, total liability shall not exceed IDR 500,000.

13. Indemnification

You agree to indemnify Neurakara Labs from claims arising from your violation of these Terms or misuse of the App.

14. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted within 30 days per our Privacy Policy.

15. Dispute Resolution

These Terms are governed by the laws of the Republic of Indonesia. Disputes shall be submitted to the District Court of Central Jakarta, unless otherwise required by consumer protection law.

16. General Provisions

These Terms and our Privacy Policy constitute the entire agreement. If any provision is invalid, the remainder continues in effect. In case of conflict between English and Bahasa Indonesia versions, the Bahasa Indonesia version shall prevail.

17. Changes to These Terms

We may update these Terms. Material changes will be notified at least 30 days before taking effect.
